By James Woods
Managing Partner

New York City, NY (Law Firm Newswire) May 04, 2022 – On April 29, 2022, after three days of testimony in Supreme Court, New York County, the Court in EPMMNY LLC v. NYCANNA LLC et al., Index No. 655480/2018, decided the issue of whether plaintiff EPMMNY LLC had capacity to initiate the November 2, 2018 lawsuit against Acreage et al. The Honorable Andrea Masley decided in favor of EPMMNY LLC, permitting the action to proceed.

The litigation involves a corporate dispute as to an ownership interest in a New York State cannabis license, which is purportedly valued in excess of $200 million. The Court held the evidence established the lawsuit was duly authorized by David Feder, a majority member in interest of the plaintiff company. Plaintiff’s counsel, James Woods of Woods Lonergan PLLC, handled the hearing and advised that their client stands ready to move forward with this litigation and vigorously pursue its claims.
